General Terms and Conditions of Sale

ElectroCroissant is owned and operated in France by “Entreprise Individuelle Rayhan RAHIM KHAN”, a sole proprietorship -Siren : 918022666, adress : 53 ter rue aux ligneaux, 45000 Orléans, France- registered in France.

These Terms and Conditions of Sale govern the contractual relationship between ElectroCroissant and any customer, including international and English-speaking customers purchasing from our website.

1. Sale of Art Prints

1.1 Printing of Prints

Art prints are produced on demand by an external printing service selected by Electrocroissant.

1.2 Scope of Purchase

The client purchases only the physical copy of the selected print. The purchase of a print does not grant any rights to exploit, reproduce, copy, or distribute the artwork in any form.

1.3 Delivery Times and Conditions

Delivery times are generally between 3 and 5 days but may vary depending on your location.
The delivery times provided are estimates only. Electrocroissant cannot be held responsible for delays caused by the carrier or by any external event that prevents or slows down delivery.
Once the package has been handed over to the carrier, the risk of delay is transferred to the client.
A delivery delay shall not give rise to a refund, cancellation of the order, or compensation, unless required by mandatory legal provisions.
In the event of a significant delay, Electrocroissant will assist the client with the carrier’s claims process, without this constituting an acceptance of liability.

1.4 Withdrawal Right and Guarantees

In accordance with European consumer law (Article L221-28 of the French Consumer Code), the purchase of an art print—made to order and produced specifically for the client—does not fall within the scope of the withdrawal right.
In the event of a manufacturing or printing defect, the applicable legal guarantee will apply.

1.5 Defects in the Print

If the package appears damaged upon delivery, please notify the courier and issue a written reservation at the time of receipt.
If a printing defect or damage is discovered after opening the package, please provide photographic evidence. These elements will allow us to assess the issue and determine the appropriate solution (reprint or replacement).

1.6 Variations in Colour and Rendering

Minor variations in colour or appearance may occur depending on screen settings and printing processes. Such variations do not constitute a defect.

1.7 Prices, Taxes and Shipping Costs

Depending on the country of delivery, customs duties or other taxes may apply. It is the client’s responsibility to check any applicable charges before placing an order. Payment of customs duties and taxes is the responsibility of the client.

1.8 Force Majeure

Electrocroissant cannot be held liable for difficulties arising from events of force majeure (such as strikes, severe weather, transport disruptions, or any event beyond its reasonable control).

1.9 Applicable Law and Jurisdiction

These Terms and Conditions are governed by French law. In the event of a dispute, the competent courts shall be those of the jurisdiction of Orléans, France.

2. Subscription

2.1 Definition of the subscription

The subscription allows the subscriber to access exclusive content on ElectroCroissant. This content can be accessible directly after the first payment or after a certain after a certain period for specific content.

By completing the purchase, the subscriber expressly consents to immediate access to the content and acknowledges waiving their 14-day right of withdrawal.

The price can vary during the time. The subscriber will be informed of any increase in his subscription price.

2.2 Payment of the subscription

When a buyer pays a subscription, he pays for the period that will come.
For example, if he pays May 1st for 1 month, he will be granted access to the exclusive content on ElectroCroissant from 1st may to 31st may.

2.3 Cancelling the subscription

The subscriber can decide to suspend or cancel his subscription at any time for free.
The subscription will still be active and the exclusive content accessible until the end of the paid period.

2.4 Refund

As the content is accessible from the first day, refund possibilities are limited and the withdrawal right doesn’t apply.

2.4.1 No partial refund

You cannot decide to cancel your subscription immediately. The subscription will still be active until the end of the period paid.
For example: If the buyer pays a subscription the May 1st and decided to cancel it May 15th, the subscription will still be active until May 31st and no refund will be made.

2.4.2 Exception for a refund

If you have purchased a subscription by mistake and have not accessed any exclusive content after the purchase, a refund is possible within 24 hours of purchase.

2.5 Competent jurisdiction in case of dispute

As Entreprise Individuelle Rayhan Rahim Khan that runs ElectroCroissant is a French Company this agreement shall be governed by French law.
If there is a dispute between the buyer and ElectroCroissant (Entreprise Individuelle Rayhan Rahim Khan) that cannot be solved amicably, the competent court is the Tribunal de Commerce d’Orléans in France.
